Freedom of Information Act (FOIA)

The Illinois Freedom of Information Act [5 ILCS 140] provides that all persons are entitled to full and complete information regarding the affairs of government and the official acts and policies of those who represent them as public officials and public employees consistent with the terms of this Act.

John A. Logan College accepts FOIA requests for information during normal business hours (Monday through Friday, 8:00 a.m. to 4:30 p.m., excluding College holidays). Requests submitted electronically outside normal business hours are considered received on the next business day.

All requests for information must be made in writing and may be submitted in person, electronically, or by U.S. Mail. You may use the contact information listed below or submit your request via the College’s  online Request for Public Records form.

Information Required by 5 ILCS 140/4

5 ILCS 140/4(a) – Brief Description of the Public Body

John A. Logan College (“the College”) is a public community college organized under the Illinois Public Community College Act and serves residents of Community College District No. 530 in southern Illinois. The College’s primary purpose is to provide accessible, affordable postsecondary education, workforce development, and community enrichment through transfer programs, career and technical education, adult education, and continuing education.

The College operates as a unit of local government and is governed by an elected Board of Trustees, which establishes policy and exercises control over the College’s operations, finances, and procedures. The Board appoints the College President, who serves as the chief executive officer and is responsible for the administration and day‑to‑day operations of the institution.

The College’s functional subdivisions include instructional services, student services, administrative and business services, institutional advancement, and campus support operations. John A. Logan College maintains its primary campus in Carterville, Illinois, and operates additional instructional or administrative locations as necessary to support its educational mission.

5 ILCS 140/4(b) – Methods for Requesting Public Records

Pursuant to the Illinois Freedom of Information Act (5 ILCS 140), members of the public may request access to public records maintained by John A. Logan College.

Submission of Requests
All FOIA requests must be made in writing and may be submitted in person, by U.S. Mail, or electronically. Requests may also be submitted through the College’s online Request for Public Records form.

Response Time
The FOIA Officer will respond to requests within five (5) business days of receipt, unless an extension is permitted by law. Requests made for a commercial purpose will be responded to within twenty‑one (21) business days, as provided by statute.

Fees
The first 50 pages of black‑and‑white, letter‑ or legal‑sized copies are provided at no charge. Additional pages are charged at $0.15 per page. Fees for electronic media, specialized copying, or oversized documents are assessed at actual cost, as permitted under Section 6 of the Act.

Right to Review
Any person whose request is denied may seek review by the Public Access Counselor in the Office of the Illinois Attorney General.

Pursuant to Section 3.5(a) of the Illinois Freedom of Information Act, the Freedom of Information Officer has identified categories of public records that are generally available for immediate disclosure upon request, unless otherwise exempt under the Act.

Availability of records for immediate disclosure does not alter the College’s obligation to review each request under the Freedom of Information Act.
